Q: The branches of my neighbour's tree overhang my garden, can you tell them to cut them back?
If a neighbour's tree overhangs an adjoining property, you can ask the tree owner to trim back the tree.
If they are unwilling to do this, in common law you are entitled to prune 'unprotected' (see 'Protected Trees' guidance) trees and hedges that overhang your land, and the roots growing under your land, up to the boundary without the consent of the owner, but you must not trespass onto your neighbour's land to do this.
In addition you must offer to return the timber and any fruit attached or which has fallen onto your land. (This does not mean dumping prunings in your neighbour's garden!).
A note of caution - you may be liable for criminal damage if any work that you do, or ask others to do for you, causes the tree to die or become dangerous.
