Road Adoptions
Any new housing development that involves the construction of more than five dwellings off a road will be subject to a either Section 38 Agreement, under Section 220, or an Advance Payments Code, under Section 219 of the Highways Act 1980.
This requires the developer to pay, or secure, a sum of money equivalent to that needed to construct the roads and footways to an adoptable standard to serve the properties.
Roads and footways can also become adopted, and thus maintained by the Council, through dedication by the land-owner. The roads and footway, however, must be constructed to a standard which will be approved by the Council. The construction standard that roads and footways have to be constructed to can be viewed in the Design Guide and Specification.
