Landlord waste and the Household Waste Recycling Centre
Important information for landlords
Waste from rented properties is classed as commercial waste. This means it cannot be taken to the Household Waste Recycling Centre (HWRC) on Burn Road.
Letting property is considered a business activity. HWRCs are only licensed to accept household waste. It is illegal to knowingly deposit or accept commercial waste at these sites.
Legal responsibilities
Under Section 34 of the Environmental Protection Act 1990, landlords have a duty of care to ensure that waste from tenanted properties is disposed of legally. Failing to do so is a criminal offence and may lead to prosecution.
How to dispose of landlord waste legally
To comply with your duty of care, you can:
1. Use a licensed waste contractor
Set up a commercial waste contract with a registered waste carrier. Always ask to see their licence and check it on the Environment Agency’s Public Register.
2. Contact local reuse schemes
Some organisations collect unwanted furniture and electrical items for free. Items must be in good condition, working, and meet fire safety regulations.
3. Request a bulky waste collection

4. Use a licensed waste facility
You can take waste to a licensed waste transfer station. If you transport the waste yourself, you must register for a waste carrier's licence with the Environment Agency.
5. Add a clause to tenancy agreements
Include a clause requiring tenants to remove all waste at the end of their tenancy. If they don’t, you may deduct the cost of removal from their deposit.
