Planning and Development

DNRS1  The obtaining of information under Section 330 of the Town and Country Planning Act 1990 as to interests in land. 
DNRS2 The obtaining of particulars of persons interested in land under Section 16 of the Local Government (Miscellaneous Provisions) Act 1976. 
DNRS3 To determine, in consultation with the Chair of Planning Committee, all forms of planning and other applications/notifications and certificates under the Town and Country Planning Act 1990 (as amended), the Planning (Listed Buildings and Conservation Areas) Act 1990, the Planning (Hazardous Substances) Act 1990, the Planning Act 2008 or under any related secondary legislation (General Permitted Development Order etc.) except those reserved to the Planning Committee.

Matters which will be exercised by the Director and to be reported for information to the next available meeting of the Committee:

  • a) To serve a Tree Preservation Order.
  • b) To serve a hedgerow retention notice.
  • c) To require the discontinuance of a use of land
  • d) To serve a stop notice (including a temporary stop notice)
  • e) To issue an enforcement notice
  • f) To apply for an injunction restraining a breach of planning control
  • g) To serve a building preservation notice and related powers
  • h) To issue enforcement notice in relation to demolition of unlisted building in conservation area
  • i) To acquire a listed building in need of repair and to serve a repairs notice
  • j) To apply for an injunction in relation to a listed building
  • k) To defend Planning enforcement Appeals
  • l) To exercise Section 215 of the Town and Country Planning Act 1990
  • m) To take any enforcement action under the Town and Country Planning Act 1990 (as amended), the Planning (Listed Buildings and Conservation Areas) Act 1990, the Planning (Hazardous Substances) Act 1990, the Planning Act 2008 or under any related secondary legislation. 
DNRS5 Power to formulate and issue decision notices following decisions made in principle by the Committee. 
DNRS6 Power to negotiate and set charges for diversion or related matters and to take action regarding blockages or Rights of Way issues other than those related to countryside management. 
DNRS7 In relation to matters which are relevant to countryside management, power to negotiate and set charges for diversion or related matters and to take action regarding blockage on Rights of Way issues. 
DNRS8 Power in cases of urgency to carry out all of the functions of the Planning Committee relating to public rights of way which are relevant to countryside management. 
DNRS9 Power to register without modification unopposed applications to register land as town or village green in respect of Town and Village Greens, following the statutory consultation period. 
DNRS10 Power to refer disputes with regard to planning application viability to the District Valuer for impartial assessment. 
DNRS11 Power to determine the designated Officer having power of entry to premises under the provisions of the Planning Acts. 
DNRS12 To consider reports on proposed changes to national planning policy in consultation with the Chair. 
DNRS13 To consider reports on the proposed Development Plan Documents of neighbouring authorities where the Council is a consultee.
