Rights of Way submissions to the Secretary of State (DEFRA)

From time to time Hartlepool Borough Council (the Council) makes orders to change public rights of way, either by diversion or extinguishment.  These may be objected to for a variety of reasons, eg:

· Wrong procedure
· Disagreement with the order being made

If this happens, the Council does its best to help the objector(s) by finding out exactly what they are objecting about.  If a compromise can be found then the Council will be requested, by the objector, to submit the order to the Secretary of State (SoS) for DEFRA, to have the order modified, taking into account what has been agreed upon by all parties.

Recently three orders were objected to, with the objections being withdrawn, with the understanding that all the relevant documentation would be submitted to the SoS. They were for the following paths:

1. Public Footpath No.20, Elwick Parish: path diversion due to approved development – 2 objections, both withdrawn

2. Public Footpath No.3, Hart Parish: path diversion due to approved development – 1 objection, withdrawn

3. Public Footpath No.9, Hartlepool: due to approved development – 1 objection, withdrawn

Secretary of State Determinations on the three submissions

1. Public Footpath No.22, Elwick Parish:
The Secretary of State (DEFRA) determined that this submission and relevant order was made incorrectly, in that part of the process had not been fully followed. The Council was directed to remake the order and re-advertise it. This was done and the new order was confirmed unopposed.

2. Public Footpath No.3, Hart Parish:
The Secretary of State (DEFRA) determined that this submission was correct and confirmed the modified order.
