Appealing a Parking Penalty Charge Notice (HX)

I have received an Order for Recovery

You received an Order for Recovery because you did not pay a Charge Certificate within 14 days.

At this stage:

  • the Penalty Charge Notice (PCN) has been registered as a debt
  • the debt has been registered with the Traffic Enforcement Centre (TEC)

You should not ignore an Order for Recovery.

What you can do now

Your options are:

Pay the outstanding amount

You can pay the full outstanding debt to stop further action.

Pay your PCN debt

Submit a Witness Statement

You can submit a Witness Statement to the Traffic Enforcement Centre within 21 days of getting the Order for Recovery

When you can submit a Witness Statement

The Witness Statement allows you to explain why the PCN has reached this stage.

You can only submit a Witness Statement if one of the following applies:

  • you did not receive the Notice to Owner
  • you appealed to the council within 28 days of receiving the PCN and did not receive a Notice of Rejection of Representations
  • you appealed to the Traffic Penalty Tribunal and did not receive a response
  • your PCN has already been paid within 28 days of the Notice to Owner

You must not submit a Witness Statement for any other reason.

What happens after you submit a Witness Statement

After you send the Witness Statement to TEC you must wait for their reply. They will let you know their decision and what happens next.

If the Witness Statement is accepted

If TEC accept your Witness Statement, they will notify you and the Council.

We will then send you a further letter giving you your options.

If the Witness Statement is rejected

If the TEC rejects your Witness Statement:

  • you must pay the full outstanding amount
  • enforcement action may continue if payment is not made
