CCTV and the Law
Normally a CCTV system being used by a private individual to protect their own domestic home will not be covered by the terms of the Data Protection Act 2018 (assuming that its cameras are not filming outside of the property boundary). For further information please see the Information Commissioners website.
However the private use of CCTV could be subject to complaints of:
- Infringement/invasion of privacy under the Human Rights Act 1998 - Article 8 - The Right to Respect for Private and Family Life, Home and Correspondence.
- Harassment under the Protection from Harassment Act 1997.
- Voyeurism under the Sexual Offences Act 2003.
If you are concerned that CCTV is being used for harassment, anti-social behaviour or other matters dealt with under criminal law you should contact Cleveland Police.
If you are installing CCTV to protect your business premises you will need to comply with the Data Protection Act 2018, the General Data Protection Regulation, the Information Commissioners Data Protection Code of Practice for Surveillance Cameras and Personal Information and register your CCTV system with the Information Commissioner. Please see the www.gov.uk website for further information.
